To promote law-based governance, further regulate the exercise of discretion over ecological and environmental administrative penalties, implement the Guidance on Further Standardizing the Application of The Discretion of Environmental Administrative Punishment issued by the Ministry of Ecology and Environment(Circular Enforcement [2019] No. 42), promote the unity of ecological and environmental law enforcement in the Yangtze River Delta, in accordance with the Law of the People's Republic of China on Administrative Punishment, measures for Environmental Administrative Punishment and other laws and regulations, Jiangsu Provincial Department of Ecology and Environment formulated and issued the Benchmark Provisions on The Discretion of Ecological And Environmental Administrative Penalties of Jiangsu Province (hereinafter referred to as the Benchmark Provisions).

The promulgation of the "Benchmark Provisions" has unified the law enforcement standards for the ecological environment in the Yangtze River Delta region, which is conducive to the formation of a unified and standardized law enforcement and supervision system for the ecological environment in the Yangtze River Delta region. At the same time, laws and regulations on ecological and environmental protection have been constantly adjusted and improved. The promulgation of the Benchmark Provisions has provided clear guidance and norms for law enforcement personnel, thus stimulating market vitality and optimizing the business environment.

The benchmark Provisions shall be applicable to the administrative penalty discretion of ecological and environmental departments at all levels in Jiangsu Province. Due to the differences in economic development level, industry and scale in different regions, the "benchmark Provisions" allow each city to adjust (increase or decrease) the amount of fines based on the scale based on actual conditions.
